TERMS AND CONDITIONS OF SALE
Last updated: 14 July 2026
These Terms and Conditions of Sale govern purchases made through the online stores operated under the Sylvie Majerová brand, including the websites sylviemajerova.cz and sylviemajerova.com.
1. Seller
The seller is:
Sylvie Majerová
Sole trader established under the laws of the Czech Republic
Place of business: Pod Kapradí 102, 517 43 Potštejn, Czech Republic
Company ID: 04387791
Email: sylviemajerova@seznam.cz
Telephone: +420 777 240 219
Hereinafter referred to as the “Seller”, “we”, “us” or “our”.
2. Scope of these Terms
2.1. These Terms apply to contracts concluded between the Seller and an individual purchasing goods for purposes outside their trade, business, craft or profession, hereinafter referred to as the “Customer” or “you”.
2.2. Purchases made by businesses or other persons acting in the course of their professional activity may be subject to separately agreed terms.
2.3. Any individually agreed terms, including a written quotation for a bespoke jewellery commission, take precedence over these Terms to the extent that they differ from them.
2.4. The version of the Terms presented to the Customer at the time the order is placed forms part of the purchase contract.
3. Products and product information
3.1. The online store offers handmade jewellery, accessories and other products designed or selected by Sylvie Majerová.
3.2. Product descriptions, photographs, dimensions, materials, gemstone information, availability and estimated production times are stated on the relevant product page.
3.3. Every handmade piece is created individually. Minor differences in texture, surface finish, shape, colour or placement of handmade elements may occur. Natural gemstones may contain inclusions, colour variations and other natural characteristics.
3.4. Such variations do not constitute a defect where they are consistent with the product description, the nature of the material and the reasonable expectations created by the product presentation.
3.5. Colours may appear slightly different depending on the Customer’s screen and device. This does not affect the Customer’s statutory rights where the delivered product materially differs from its description.
3.6. Unless expressly stated otherwise, jewellery is not intended as a toy and should be kept out of reach of small children.
3.7. Articles made from precious metals are marked and hallmarked where required by applicable law.
4. Product availability
4.1. Products may be offered as:
a) in stock;
b) one of a kind;
c) made to order; or
d) individually customised or commissioned.
4.2. One-of-a-kind pieces are available only while stocks last.
4.3. Due to the unique nature of certain products, an item may exceptionally be sold through another sales channel before the online inventory is updated. If we are unable to fulfil an accepted order, we will notify the Customer without undue delay and refund all payments received for the unavailable item.
4.4. Unless a different period is stated on the product page:
a) in-stock products are normally dispatched within 1–3 business days;
b) made-to-order products are normally completed within approximately 3–8 weeks.
4.5. The production period stated on the product page or individually agreed with the Customer forms part of the contract.
5. Orders and conclusion of the contract
5.1. The presentation of products in the online store is an invitation to place an order and does not in itself constitute a binding offer by the Seller.
5.2. The Customer selects the products, required options, delivery method and payment method through the online checkout.
5.3. Before submitting the order, the Customer may review and correct the entered information.
5.4. By submitting an order through a button clearly indicating an obligation to pay, the Customer places a binding order for the selected products.
5.5. After receiving the order, we will send an electronic confirmation to the email address provided by the Customer.
5.6. The purchase contract is concluded when we expressly confirm acceptance of the order. An automated message merely confirming receipt of an order may be identified as such and does not constitute acceptance.
5.7. If payment has already been collected and the order cannot be accepted, the payment will be refunded without undue delay.
5.8. The Customer is responsible for providing complete and accurate contact, billing, delivery and customisation information.
5.9. In the case of a customised ring, the Customer is responsible for supplying the requested ring size accurately. This does not affect the Customer’s rights where the item is defective or has not been made in accordance with the agreed specification.
6. Custom Design and bespoke commissions
6.1. Bespoke commissions and substantial modifications may be subject to an individual quotation or written order specification.
6.2. The individual agreement may specify, in particular:
a) the design and approved concept;
b) the precious metal and gemstone selection;
c) the dimensions and ring size;
d) the total price and payment schedule;
e) the estimated production period; and
f) the number and scope of permitted design revisions.
6.3. Once approved, the individual specification forms part of the contract.
6.4. Any material change requested after approval may affect the price and completion date and must be accepted by both parties.
7. Prices
7.1. The price applicable to the order is the price displayed in the online store at the time the order is submitted.
7.2. Prices include all taxes that the Seller is legally required to include. Delivery charges and any other applicable costs are displayed separately before the Customer submits the order.
7.3. The final amount payable is shown in the checkout before the order is placed.
7.4. Where the store displays prices in more than one currency, the currency selected or shown during checkout will be the currency of the contract.
7.5. The Customer’s bank or payment provider may apply its own currency conversion rate or transaction fee. Such charges are not imposed or controlled by the Seller.
7.6. In the event of an obvious technical or typographical pricing error, we will contact the Customer before accepting the affected order. The Customer may either confirm the order at the correct price or cancel it without charge.
8. Payment
8.1. Available payment methods are displayed during checkout and may include payment card, bank transfer or other electronic payment methods.
8.2. Unless otherwise agreed, the full purchase price must be paid before the product is dispatched.
8.3. Custom Design orders may be subject to an individually agreed deposit or payment schedule.
8.4. Payment is considered completed when the relevant amount is credited to the Seller or confirmed by the payment provider.
8.5. The Seller will provide the Customer with an invoice or other proof of purchase electronically or together with the order.
9. Delivery
9.1. Products are delivered to the countries and destinations offered during checkout.
9.2. Available carriers, delivery methods and prices are displayed before the Customer submits the order.
9.3. Delivery times shown in the store are estimates unless a binding delivery date has been expressly agreed.
9.4. The estimated transport time begins only after the product has been completed and dispatched. Production time and transport time are separate periods.
9.5. The Seller is responsible for delivering the goods within the agreed period. Where no specific delivery or production period has been agreed, delivery will take place without undue delay and within the period required by applicable law.
9.6. The risk of accidental loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.
9.7. If the Customer independently appoints a carrier that was not offered by the Seller, the risk may pass to the Customer when the goods are handed over to that carrier, as permitted by applicable law.
9.8. The Customer should inspect the parcel upon delivery and report any visible transport damage as soon as reasonably possible. Failure to report visible damage immediately does not remove the Customer’s mandatory statutory rights.
9.9. Where delivery cannot be completed because of incorrect information provided by the Customer, refusal to accept the parcel or failure to collect it, the Customer may be required to pay the reasonable and demonstrable cost of repeated delivery or return transport.
10. Right of withdrawal
10.1. A Customer who is a consumer generally has the right to withdraw from a distance purchase contract without giving a reason within 14 days.
10.2. For a contract concerning one product, the withdrawal period expires 14 days after the day on which the Customer or a third party designated by the Customer, other than the carrier, takes physical possession of the product.
10.3. Where several products ordered together are delivered separately, the period expires 14 days after possession of the final product.
10.4. To exercise the right of withdrawal, the Customer must send a clear statement of their decision to withdraw to:
Sylvie Majerová
Pod Kapradí 102
517 43 Potštejn
Czech Republic
Email: sylviemajerova@seznam.cz
10.5. The Customer may use the model withdrawal form at the end of these Terms, but its use is not mandatory.
10.6. It is sufficient for the withdrawal notice to be sent before the withdrawal period expires.
11. Exceptions from the right of withdrawal
11.1. The right of withdrawal does not apply to goods that have been made to the Customer’s individual specifications or are clearly personalised.
11.2. This may include, in particular:
a) jewellery engraved with a name, date, initials or other individual text;
b) a product manufactured according to an individually approved design;
c) a piece made with a gemstone, metal or design alteration specifically selected and agreed for the Customer;
d) a ring manufactured or permanently resized specifically to the Customer’s selected size, where it was not a standard stock item and cannot reasonably be resold without further alteration; or
e) another product permanently modified at the Customer’s request.
11.3. Where this exception applies, the product page, customisation process, quotation or order confirmation will clearly inform the Customer before the contract is concluded.
11.4. A product is not excluded from the right of withdrawal solely because it is handmade or because production begins only after the order is placed. The product must be genuinely made or altered according to the Customer’s individual choice or specification.
11.5. A ready-made one-of-a-kind product purchased in the size and condition in which it was offered is not considered personalised merely because only one piece exists.
11.6. Any other statutory exception applies only where all conditions required by applicable law have been met and the Customer was properly informed before placing the order.
12. Returning products after withdrawal
12.1. The Customer must return the product without undue delay and no later than 14 days after notifying us of the withdrawal.
12.2. Returned products must be securely packaged and sent to the return address stated in Article 10.4, unless we provide a different return address.
12.3. The Customer bears the direct cost of returning the product after withdrawal.
12.4. We recommend using an insured and trackable delivery method, particularly for jewellery and other high-value goods. The Customer remains responsible for the parcel until it is delivered to us.
12.5. The Customer may handle and inspect the product only to the extent necessary to establish its nature, characteristics and functionality, in the same manner as would normally be permitted in a physical shop.
12.6. The Customer is responsible for any diminished value resulting from handling beyond what is necessary for such inspection.
12.7. Removing ordinary gift packaging does not automatically remove the right of withdrawal. However, missing or materially damaged product packaging, certificates or accessories may be taken into account where this demonstrably reduces the product’s value.
13. Refunds following withdrawal
13.1. We will refund all payments received for the returned product, including the cost of the least expensive standard delivery method offered for the original order.
13.2. Additional costs resulting from the Customer’s choice of an expedited or more expensive delivery method are not refundable to the extent that they exceed the cost of standard delivery.
13.3. The refund will be made without undue delay and no later than 14 days after we are informed of the withdrawal.
13.4. We may withhold the refund until we have received the returned product or until the Customer provides evidence that the product has been sent back, whichever occurs first.
13.5. The refund will be made using the same payment method used for the original transaction, unless the Customer expressly agrees to another method. The Customer will not be charged a refund fee by the Seller.
13.6. Any deduction for diminished value will be reasonable, proportionate and based on the actual condition and reduced value of the returned product.
14. Statutory rights relating to defective goods
14.1. The Seller is responsible for ensuring that the product conforms to the purchase contract when delivered.
14.2. In particular, the product must:
a) correspond to the agreed description, type, quantity and quality;
b) possess the characteristics expressly agreed with the Customer;
c) be suitable for the agreed purpose;
d) be supplied with the agreed accessories, packaging and instructions; and
e) possess the durability, safety and other characteristics that a consumer may reasonably expect from products of the same type.
14.3. The Seller is responsible for a lack of conformity that becomes apparent during the statutory liability period. Under Czech consumer law, this period is generally two years from delivery. A longer or otherwise more favourable mandatory period under the law applicable to the Customer remains unaffected.
14.4. Where a lack of conformity becomes apparent during the first year after delivery, it is presumed to have existed at delivery unless this is incompatible with the nature of the product or defect.
14.5. Normal wear and tear, damage caused by accident, improper use, impact, unauthorised modification, improper storage or failure to follow reasonable care instructions does not constitute a defect attributable to the Seller.
14.6. Natural gemstone inclusions or disclosed handmade variations are not defects. However, this does not apply where the delivered product materially differs from its description or the agreed specification.
15. Remedies for defective goods
15.1. If a product is defective, the Customer may request that it be brought into conformity by repair or replacement, unless the chosen remedy is impossible or would impose disproportionate costs compared with the alternative remedy.
15.2. The repair or replacement will be carried out free of charge, within a reasonable time and without significant inconvenience to the Customer.
15.3. Because many products are unique or one of a kind, replacement with an identical product may be impossible. In such a case, we will discuss an appropriate alternative, repair, price reduction or refund with the Customer in accordance with applicable law.
15.4. The Customer may be entitled to a proportionate price reduction or to terminate the contract where, in particular:
a) repair or replacement is impossible or disproportionate;
b) the Seller fails to remedy the defect within a reasonable time;
c) the defect recurs;
d) the defect is sufficiently serious; or
e) it is apparent that the Seller will not bring the product into conformity without significant inconvenience.
15.5. The Customer may not terminate the contract for a defect that is legally insignificant where applicable law excludes termination for such a minor defect.
15.6. Any statutory extension of the liability period following repair applies where required by applicable law.
16. Making a complaint
16.1. Complaints may be submitted by email or sent with the product to:
Sylvie Majerová
Pod Kapradí 102
517 43 Potštejn
Czech Republic
Email: sylviemajerova@seznam.cz
16.2. The complaint should include, where available:
a) the Customer’s name and contact details;
b) the order number or other proof of purchase;
c) a description of the defect and when it appeared;
d) photographs where helpful; and
e) the preferred remedy.
16.3. We may ask the Customer to send or otherwise make the product available for inspection where reasonably necessary.
16.4. Where the complaint is justified, the Seller will bear the necessary cost of repair, replacement and reasonable return transport.
16.5. We will confirm receipt of the complaint and inform the Customer of its outcome.
16.6. Complaints will be handled without undue delay. Where Czech law applies, a consumer complaint will be resolved, including removal of the defect and notification to the Customer, no later than 30 days after it is submitted, unless a longer period is expressly agreed with the Customer.
17. Care, repairs and resizing
17.1. Care instructions provided with the product or on the product page form part of the product information.
17.2. Jewellery should generally be protected from impact, excessive force, chemicals, cosmetics, salt water and other conditions that may damage the metal, gemstone, patina or surface finish.
17.3. Resizing, repairs or modifications requested after delivery may be charged separately where they are not required to remedy a defect for which the Seller is responsible.
17.4. A product altered by a person other than the Seller may no longer be eligible for a remedy to the extent that the alteration caused or contributed to the claimed defect.
18. User accounts
18.1. Where the online store allows the creation of a customer account, the Customer is responsible for keeping their login details confidential.
18.2. The Customer must provide accurate information and update it where necessary.
18.3. The Seller may suspend or close an account where reasonably necessary because of misuse, a security risk or a material breach of these Terms.
18.4. Closing an account does not affect existing orders, statutory rights or obligations that arose before closure.
19. Personal data and cookies
19.1. Personal data is processed in accordance with the Seller’s separate Privacy Policy.
19.2. Information about cookies and similar technologies is provided in the separate Cookie Policy and through the website’s consent settings.
19.3. Consent to receive marketing communications is voluntary and is not a condition of making a purchase.
19.4. The Customer may withdraw marketing consent or unsubscribe at any time using the method stated in the relevant communication or Privacy Policy.
20. Intellectual property
20.1. Product designs, photographs, texts, illustrations, logos and other content presented in the online store are protected by intellectual property law.
20.2. Purchasing a product does not transfer any copyright, design right, trademark or other intellectual property right to the Customer.
20.3. Content from the online store may not be commercially copied, reproduced, modified or used without the Seller’s prior permission, except where permitted by law.
21. Events outside the Seller’s reasonable control
21.1. The Seller is not responsible for a delay caused by an event outside the Seller’s reasonable control, such as a natural disaster, serious transport disruption, government restriction or comparable extraordinary event.
21.2. The Seller will inform the Customer of a material delay and take reasonable steps to minimise its effects.
21.3. Where performance becomes impossible or is delayed beyond a reasonable period, the Customer retains all cancellation and refund rights provided by applicable law.
22. Alternative dispute resolution
22.1. We encourage Customers to contact us first so that any complaint or dispute can be resolved directly.
22.2. The competent Czech alternative dispute resolution body for consumer disputes is:
Czech Trade Inspection Authority
Česká obchodní inspekce
Gorazdova 1969/24
120 00 Praha 2
Czech Republic
Further information and the electronic ADR application are available through the official website of the Czech Trade Inspection Authority.
22.3. Cross-border consumers may also contact the European Consumer Centre in their country of residence for information and assistance.
22.4. Participation in alternative dispute resolution does not prevent either party from bringing the matter before a competent court.
23. Governing law and consumer jurisdiction
23.1. These Terms and the purchase contract are governed by the laws of the Czech Republic.
23.2. This choice of law does not deprive a consumer residing in another country of the protection afforded by mandatory provisions of the law of the country in which the consumer has their habitual residence, where those provisions apply under European Union or other applicable conflict-of-law rules.
23.3. Any dispute may be brought before the courts having jurisdiction under applicable European Union and national rules. Nothing in these Terms restricts a consumer’s right to bring proceedings before a court competent under mandatory consumer-protection law.
24. Language
24.1. The contract may be concluded in the language offered in the relevant version of the online store.
24.2. The version of these Terms presented to the Customer during checkout applies to the order.
24.3. If these Terms are available in several languages, each language version should convey materially the same rights and obligations. In the event of a conflict, the interpretation most consistent with mandatory consumer law and the information presented to the Customer before purchase will apply.
25. Amendments and final provisions
25.1. We may amend these Terms from time to time. Amendments do not affect contracts concluded before the amended Terms became effective.
25.2. If any provision is found to be invalid or unenforceable, the remaining provisions remain effective. The invalid provision will be replaced or interpreted to reflect its lawful purpose as closely as possible without reducing the Customer’s mandatory rights.
25.3. The purchase contract and applicable Terms are provided to the Customer electronically. The Customer should retain the order confirmation and Terms for future reference.
25.4. Nothing in these Terms excludes, restricts or modifies any consumer right that cannot lawfully be excluded, restricted or modified.
